On 29 March, 12:40, this year the port dispatcher-coordinator of rescue works on duty of the port Dispatcher Office received a notice from the operator on duty of the Vessel Traffic Service that in the water area of AB „Laivitė“ there were two rubber boats with people on board sailing nearby ships berthed at the quays of the mentioned company. This event was related to the duty inspector of the Port Supervision Department, Head of the Port Supervision and Rescue Service, Head of the Port Regime Department and inspectors of the Sea Environment Protection Agency who immediately went to the site of the event to clarify the situation.
Upon arrival on the scene, it was seen that the boats had sailed close to the quays of the ship repair yard AB „Klaipėdos laivų remontas“. These motorboats displayed logos Green Peace. People on board (having approached the fishing vessels berthed at the cruise ship terminal of AB „Klaipėdos laivų remontas“) were making inscriptions with paint on the hulls of vessels, notwithstanding warning to withhold from such actions.
Following arrival of J.Saudargas, Head of the Port Supervision Department of the State Enterprise Klaipeda State Seaport Authority (KSSA), E.Kuzmarskis, Head of the Port Regime Department, officers of the State Border Guard Service, the representatives of the organization Green Peace were accompanies in the rescue boat „Žaibas“ and boat „Audra“ to the KSSA Ship Depot. Representatives of the organization Green Peace included citizens of Germany, Poland, Russia, Hungary and other countries.
Two representatives of Green Peace who ran the boats were issued reports on breach of administrative law for violation of the navigation regulations of the KSSA and inflicted penalties (each person LTL 300,00). Thereafter the boat “Žaibas” accompanied representatives of Green Peace with their motorboats to the Yacht Club where the crews placed the boats on the quayside.
The State Enterprise Klaipeda State Seaport Authority notifies that the vessels (on which representatives of Green Peace made inscriptions) were berthed at the port of Klaipeda on a legal basis (i.e., Authority of the Port did not have any legal basis to refuse their entry into the port).
Furthermore, Klaipeda State Seaport Authority acts in pursuance with the requirements of Annex III Article 13 of EC Regulation 51/2006 of 22 December 2005 (Council Regulation (EC) No 51/2006 fixing for 2006 the fishing opportunities and associated conditions for certain fish stocks and groups of fish stocks, applicable in Community waters and, for Community vessels, in waters where limitations in catch are required (OL, 2006, L 016, p. 1)) which says that if such ships enter the ports of the Member States they shall be immediately inspected and such vessels shall not be supplied with provisions, fuel or other services:
a) IUU vessels (vessels engaged in illegal, unreported and unregulated fisheries) that enter ports are not authorised to land or tranship therein and shall be inspected by the competent authorities. Such inspections shall include the vessel’s documents, log books, fishing gear, catch onboard and any other matter relating to the vessel’s activities in the Regulatory Area of NEAFC (the North-East Atlantic Fisheries Commission). Information on the result of the inspections shall immediately be transmitted to the Commission;
b) fishing vessels, support vessels, refuel vessels, mother-ships and cargo vessels flying the flag of a Member State shall not in any way assist IUU vessels or participate in any transhipment of joint fishing operations with vessels on that list;
c) IUU vessels shall not be supplied in ports with provisions, fuel or other services;
d) IUU vessels shall not be authorised to fish in Community waters and be prohibited to be chartered;
e) imports of fish coming from IUU vessels shall be prohibited;
f) Member States shall refuse the granting of their flag to IUU vessels and encourage importers, transporters and other sectors concerned to refrain from negotiating and from transhipping of fish caught by such vessels.
In addition, the State Enterprise Klaipeda State Seaport Authority notifies that all the abovementioned requirements shall apply to any vessels landed at the port of Klaipeda and presence of the mentioned vessels at the port is legal.
